IMPORTANCE OF USING THE CORRECT DOCUMENT

The Arab British Certificate of Origin is the international trade document for use in attesting goods whose destination is any of the Arab countries (excluding Egypt). The Arab British Certificate of Origin is a unique, English/Arabic Certificate of Origin which fully conforms to international regulations and is accepted by all the Arab governments. Therefore, using alternative certificate of origin for any goods destined to Arab countries will cause delays and extra charges. The attached letter from the Arab League office in London signed by H.E. Mr Khaled AI-Duwaisan, GCVO, the Ambassador of Kuwait and the Dean of Arab Ambassadors, on behalf of the Arab Ambassadors’ Council in the UK, underpins the documentary requirements of the Arab League states, excluding Egypt which has its own chamber of commerce.

The requirements are as follows:

• The Arab-British Chamber of Commerce (ABCC) must verify and certify all commercial documents destined to Arab League states. Commercial documents cannot be submitted to embassies for legalisation if they have not been certified by the ABCC.

• The Arab-British Certificate of Origin must be used for all goods destined for Arab League states. No other certificate can be used. This letter gives clarity to exporters and to protect them from delays and unnecessary costs at customs when using alternative documents to the Arab British Certificate of Origin.

Letters of Credit become mandatory from 13.02.2022 - Latest News on Import to Egypt

Regulatory changes announced by the Central Bank of Egypt:
The Central Bank of Egypt has stopped the usage of documentary collection for all imports into the country with immediate effect from 12 February 2022 leaving letters of credit as the only acceptable method for payment. This came with a few exceptions which included branches of foreign companies and their affiliated companies. Documentary collection will only be accepted for goods shipped to Egypt before the date of this decree (12 Feb 2022). This decree came as Egypt is making the usage of the ACI system mandatory as of 1 Mar 2022.

As one of the governance procedures to regulate the importation process of goods into Egypt, the decision was made to stop all import transactions through collection of documents and use bank to bank transactions instead.

The only approved way of importing is through letters of credit from importers. This was followed by announcements of exemptions of sectors to the above regulation. The Central Bank of Egypt (CBE) excluded imports of medicines, serums, relevant chemical substances, and some food commodities from the recent decision.

The food items that were excluded include: tea, meat, chicken, fish, wheat, table oil, baby formula, powder milk, bean, lentils, butter, and maize.
The exclusion decision also applies to express mail shipments and shipments that are worth up to $5,000 or an equivalent amount in other currencies.

The CBE has also directed all banks to reduce their commission for opening documentary credits to be equal to the commission paid for collection documents,
as not to add financial burdens for the trader.

Mandatory implementation of ACI system for Sea Freight only

The Egyptian Ministry of Finance announced on 23 June the amendment of some provisions of Decree 38 concerning Advance Cargo Information (ACI).
The trial implementation period for the Advance Cargo Information (ACI) system for the imported shipments in the seaports stipulated in Article 4 of the Decree of the Minister of Finance No. 38 of 2021 referred to as (first phase) the actual binding implementation of this systems starts from 1st of October 2021

LEGALISATION INSTRUCTIONS:

CERTIFICATE OF ORIGIN & INVOICE

  1. The Iraqi Commercial Attaché will only legalise the Certificate of Origin and the Invoice after they have been stamped by the FCDO and the Arab-British Chamber of Commerce.
  2. The invoice should be issued by a company based in the UK and its address should appear on the invoice and the final destination of the goods should be Iraq; in addition, the full details of the goods and total amount should appear. Note: A commercial invoice with an address outside the UK, even if it refers to being on behalf of a UK addressed company, is not accepted.
  3. The commercial invoice should hold one address in the UK or Ireland, any additional address (printed or stamped) will not be accepted.
  4. For each invoice, the Embassy legalises one original certificate of origin.
  5. Two identical original Certificates of Origin or invoices are not accepted. The Embassy legalises as many copies as the customer wants as long as accompanied with the originals.
  6. All documents should have a recent date.
  7. Manufacturer details must appear on the original certificate.
  8. Submit a copy of the packing list related to the documents or a transport document.
  9. If the goods are chemical materials, medicine, food or foodstuff, agricultural or animal products the company should provide a valid import licence. Note: The embassy accepts only import licenses issued by the State Company for the Iraqi Fairs and Commercial Services.
  10. The company should provide a copy of a valid contract if the goods will be supplied to the public sector (governmental companies)

The Certificate of Origin should include the following details:

  • Original /Copy
  • Consignor should be a company with full address in the UK.
  • The consignee should be in Iraq (final destination)
  • Invoice number and date should appear on the Certificate of Origin and should match with the original invoice.
  • The origin of the goods should be the UK or Ireland, in case of the origin of the goods being other than the UK or Ireland, the consignor company must submit a letter stating the goods have been produced for their benefit.

Iraqi authorities will now accept the Certificate of Conformity (CoC) issued by Bureau Veritas Company starting from 24/10/2021

Special Requirements:

The Packing List must contain invoice numbers, marks and numbers and gross weight for all items on the list.
Packing List must contain the following information for each item included in it:

  • Item description
  • The statistical symbol of the item
  • Number of packages for each item
  • Kind of packaging unit for each item
  • Net weight of each item
  • Value of each item

The following points must be carefully observed when completing the Packing List:

  • If the packing of any item contain two different kinds of packing, it must be written as two separate lines
  • If any kind of packing contains more than one item, a separate line must be allocated for the information concerning each item
  • The description of each item must contain sufficient illustration as to its kind and nature
  • If all the information required on the packing list is included in the invoice, then the packing list is not required

As regards bulk items and goods which consist of only one item, information relating to the total number of packages and Kuwait Conformity Assurance Scheme (KUCAS). The Public Authority for Industry of the State of Kuwait (PAI) has been implementing the ‘Kuwait Conformity Assurance Scheme’ (KUCAS) since 17 June, 2006. KUCAS is a set of procedures carried out by PAI to verify the conformity of all ‘Regulated Products’ to the Kuwait’s Technical Regulations and approved Standards. Exporters & manufacturers with consignments of regulated products to be shipped to Kuwait may complete the conformity procedures prior to shipment through one of the Certification and Inspection Bodies approved by PAI (e.g. SGS, Intertek) in accordance with the KUCAS Guidelines.

  • All documents must now be presented in the English language. Arabic translation etc. will no longer be accepted.
  • Invoice to include the following declaration: "We certify that the present invoice is authentic, that it is the only one issued by us for the goods mentioned there in, that it gives the exact value without deduction of any payment on account and that they are of ......... origin".
  • Each invoice should be accompanied by its own Certificate of Origin. CofO applications with more than 1 invoice will be charged extra.
  • No copy Certificate of Origin is accepted for legislation unless required by letter of Credit or Importer.
  • Medicines, chemical products and by-products should be accompanied by a declaration as to whether they are hazardous or non-hazardous and that they are free for sale in the UK. In addition, medicines and foods require an expiry date.
Other Documents:
Agency agreements, documents of information concerning a company, documents appointing a representative of a company in Lebanon and analysis/health certificates (if not accompanying CofO) all require Foreign, Commonwealth & Development Office (FCDO) Certification prior to presentation for legalisation.
